User Guide

Six33Four NG (GUEST BLOG) was developed to serve as a platform for scholars, journalist, business owners, academics, writers, students and experts to share knowledge, interate, inform and educate.

 

In order for the freelancer to offer their services on our platform they must create a freelancer account. They must fully complete the registration process by providing us with your current, complete, truthful, and accurate information as prompted by the applicable registration form. 

 

Where required, Six33Four NG may also assign you a username and password. You are entirely responsible for maintaining the confidentiality of your password and account and for any and all activities that occur under your account. You agree to notify Six33Four NG immediately of any unauthorized use of your account or any other breach of security. 

 

Six33Four NG will not be liable for any losses you incur as a result of someone else using your password or account, either with or without your knowledge. 

 

However, you could be held liable for losses incurred by Six33Four NG or another party due to someone else using your account or password. You may not use anyone else's account at any time. 

 

Freelancers may only register for one account per person and may not register as a company or group collaboration. Six33Four NG has the sole discretion in granting or denying any accounts.

 

  • Termination of Freelancer Accounts

We may terminate or suspend your account if we determine that: 

 

(1) You have violated any applicable laws while using our Platform

(2) If we believe your actions while using the Platform have harmed or will harm a third party

(3) If we believe that any of your actions may harm Six33Four NG, at our sole decision or discretion. 

 

In the event of termination, we will strive to provide you with a timely explanation; however, we are not required to do so. 

 

As a freelancer if you wish to terminate your freelancer account please notify us or use your account dashboard to terminate the account. 

 

Please be aware that once your account is terminated, all access and information including freelancer services in your existing account may become immediately inaccessible or deleted. Failure to terminate your account for any reason does not act as a waiver of your conduct.

 

  • Freelancer and User Disputes

In the event of a dispute between freelancer and user, freelancer and user agree to attempt to settle the dispute amicably and in good faith by contacting each other and attempting resolve such a dispute. 

 

If such dispute cannot be settled, freelancer or user may contact Six33Four NG. Six33Four NG, at its discretion, may assist in settling the dispute. 

 

In the event that Six33Four NG assists in any dispute resolution, freelancer and user agree to accept such resolution as resolved, binding, and final. 

 

This section does not obligate Six33Four NG to settle disputes between any users and any freelancers and all users agree that Six33Four NG is not a party to any such disputes.

 

  • Non-Circumvention

Users and freelancers acknowledge and agree that in order for Six33Four NG to make the platform available, it must receive fees for all seller services and orders transacted. 

 

In consideration for making the platform available for users and freelancers, you must use the platform as your exclusive method to request, make, and receive all payments for any seller services or orders directly or indirectly provided to or received from that party or arising out of your relationship with that party. 

 

This includes using the third-party payment processing platform we choose and following any other rules we specify. 

 

You may not circumvent your payment obligations to us by soliciting payment from a reader outside of Six33Four NG or by using any alternative method to collect subscription payments. 

 

This includes receiving payments for your resources through links to Paypal or a any other means. 

 

You agree to notify us immediately if you receive any such offer or solicitation to circumvent your payment obligations by contacting hello@six33four.ng

 

Pricing and Payments

 

You may offer your resources for free, or for a subscription fee, to be determined at your discretion. You may set and change the prices for your resources at your discretion through your account, though no price changes will apply retroactively. 

 

If you choose to charge a subscription fee for your retroactively, you agree to the following:

 

  • Donations: For writers who decide to make their contents free, a donation button would be created on their profile and on their articles. User can be elect to donate money to the writer. KYNELI Business Support Services would be entitled to earn between ten percent (10%) of the donated amount. 

 

  • Subscription Fee

The subscription fee of the resources on our platform is the sole right of the freelancer. They are free to the set the amount they feel is commesurate with their resources.

 

  • Royalty & Sales Commission

KYNELI Business Support Services owners of Six33Four NG agrees to pay between seventy percent (70%) to ninety percent (90%) of the subscription fee, depending on the level of the freelancer, to the freelancer from the subscription fee set by the freelancer when a user subscribes to their service while KYNELI Business Support Services would be entitled to earn between ten percent (10%) to twenty percent (20%) of the subscription fee.

 

  • Payment

KYNELI Business Support Services would remit the share of the freelancer into the profile account of the freelancer and same would remitted into the bank account of the freelancer within twenty four (24) hours of receiving invoice from the freelancer. 

 

Payment threshold is set at thirty thousand naira (₦ 30,000). Such payment could be through bank transfer, credit card or any means considered suitable by both parties.

 

Relationships with readers

You agree to the following rules around your relationships with Readers and other users of Six33Four NG:

Sole Responsibility: You agree that you are solely responsible for (and that we have no responsibility to you or to any third party for) any resources you distribute through Six33Four NG and for the consequences of your actions by doing so. 

 

This means that you acknowledge and agree that you are solely responsible for ensuring distribution of your resources, our actions under this Agreement are solely to assist you in facilitating distribution. 

 

Stopping Publication or Deleting a resources: You may delete one or more of your resources from Six33Four NG at your discretion. 

 

However, please note that if you delete or stop publishing a resource before the end of a paid subscription term of a reader, any and all obligations – including any refund obligations for the remaining portion of the subscription term – are solely your responsibility. 

 

We are under no obligation to issue any refunds to you or your readers and we are entitled to keep any and all portions of any revenue share you have paid Six33Four NG. 

 

Disputes: If there is a dispute between you and a user about payments or any other issue, you agree we are under no obligation to become involved and that we will not be held liable for any such dispute. 

 

We are not liable for your relationship with users, and we won’t provide you with any legal advice regarding such matters. 

Reporting a User: You can flag that a user that is violating our Terms of Use by sending an email to hello@six33four.ng. 

After you provide us with written notice of this violation, we will determine whether this user’s access to some or all of your resources should be suspended or terminated. 

We will also decide at our sole discretion whether this user’s access to the rest of Six33Four NG will be suspended or terminated. 

Support: You shall provide to us a current email address to which we may direct inquiries from readers and other Six33Four NG users regarding your resources.

Intellectual Property Claims (DMCA, Trademark Infringement) 

We respect the intellectual property rights of others and require that you do the same. Intellectual Property Rights (IPR) (e.g. copyright, patents) affect the way both you and others can use your research outputs.

Instructions to Users and Authors

Reporting Claims of Copyright Infringement (DMCA) 

Six33Four NG’s content is based on User Generated Content (UGC). Six33Four NG does not check user uploaded/created content for violations of copyright or other rights. 

However, if you believe any of the uploaded content violates your copyright or a related exclusive right, you should follow the process below. Six33Four NG looks into reported violations and removes or disables content shown to be violating third party rights.

In order to allow us to review your report promptly and effectively, a copyright infringement notice ("Notice") should include the following:

  • Identification of your copyrighted work and what is protected under the copyright(s) that you are referring to
  • Your copyright certificate(s)/designation(s) and the type, e.g., registered or unregistered 
  • Proof of your copyrights ownership, such as the registration number or a copy of the registration certificate
  • A short description of how our user(s) allegedly infringe(s) your copyright(s)
  • Clear reference to the materials you allege are infringing and which you are requesting to be removed, for example, the url, a link to the deliverable provided to a user, etc. 
  • Your complete name, address, email address, and telephone number.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement made under penalty of perjury that the information provided in the notice is accurate and that you are the copyright owner or the owner of an exclusive right that is being infringed, or are authorized to make the complaint on behalf of the copyright owner or the owner of an exclusive right that is being infringed.
  • Your electronic or physical signature

You can send your Notice to: hello@six33four.ng with Intellectual Property Claims as the subject.

Note that we will provide the user who is allegedly infringing your copyright with information about the Notice and allow them to respond. 

In cases where sufficient proof of infringement is provided, we may remove or suspend the reported materials prior to receiving the user's response. 

In cases where the allegedly infringing user provides us with a proper counter-notification indicating that it is permitted to post the allegedly infringing material, we may notify you and then replace the removed or disabled material. 

In all such cases, we will act in accordance with 17 U.S.C Section 512 and other applicable laws.

If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective.

Please be aware that if you knowingly materially misrepresent that material or activity on the Website is infringing your copyright, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

Counter-Notification Procedures

If you believe that material you posted on the site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice") by submitting written notification to our DMCA agent (identified above). 

Pursuant to the DMCA, the Counter-Notice must include substantially the following:

  • Your physical or electronic signature.
  • An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled. 
  • Adequate information by which we can contact you (including your name, postal address, telephone number and, if available, e-mail address).
  • A statement under penalty of perjury by you that you have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
  • A statement that you will consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States for any judicial district in which the Website may be found) and that you will accept service from the person (or an agent of that person) who provided the Website with the complaint at issue.

The DMCA allows us to restore the removed content if the party filing the original DMCA Notice does not file a court action against you within ten business days of receiving the copy of your Counter-Notice. 

Please be aware that if you knowingly materially misrepresent that material or activity on the Website was removed or disabled by mistake or misidentification, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

Trademark Infringement

Six33Four NG’s content is based on User Generated Content (UGC). Six33Four NG does not check user uploaded/created content for violations of trademark or other rights. 

However, if you believe any of the uploaded content violates your trademark, you should follow the process below. Six33Four NG looks into reported violations and removes or disables content shown to be violating third party trademark rights.

  • Identification of your trademark and the goods/services for which you claim trademark rights
  • Your trademark registration certificate and a printout from the pertinent country's trademark office records showing current status and title of the registration. Alternatively, a statement that your mark is unregistered, together with a court ruling confirming your rights
  • A short description of how our user(s) allegedly infringe(s) your trademark(s)
  • Clear references to the materials you allege are infringing and which you are requesting to be removed, for example, the url, a link to the deliverable provided to a user, etc. 
  • Your complete name, address, email address, and telephone number.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the trademark owner, its agent, or the law.
  • A statement made under penalty of perjury that the information provided in the notice is accurate and that you are the trademark or are authorized to make the complaint on behalf of the trademark owner
  • Your electronic or physical signature

You can send your Notice to: hello@six33four.ng with Trademark Infringement as the subject.

Note that we will provide the user who is allegedly infringing your trademark with information about the TM Notice and allow them to respond. 

In cases where sufficient proof of infringement is provided, we may remove or suspend the reported materials prior to receiving the user's response. In cases where the allegedly infringing user provides us with information indicating that it is permitted to post the allegedly infringing material, we may notify you and then replace the removed or disabled material. In all such cases, we will act in accordance with applicable law.

Repeat Infringers

It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers.

Responsible Listing Guidelines

Welcome to the responsible listing guidelines (“Guidelines”) for Six33Four NG and its affiliated websites, any capitalized terms not defined within these guidelines are defined in the Six33Four NG’s terms of service.

Six33Four NG is dedicated to creating a great experience for both its buyers and sellers.  We take our responsibilities seriously, and we work to ensure that any articles and research work listed (“Listings”) on Six33Four NG and its affiliated websites are accurate, trustworthy, and reliable.  

For these reasons, we have created the following guidelines to improve the experience of all of our users.

Listing Guidelines

Authors must comply with the following when creating any Listings:

  • Listings should not include third party trademarks or logos not owned or licensed by the author.
  • Any author articles listed should not include any trademarks or logos that are confusingly similar to a third party’s trademarks or logos.
  • The listings should not include the names, likenesses, voices, or other indicia identifying any person (living or dead) without such person’s permission.
  • The listings should not contain copyrighted materials owned by others, without permission.
  • The listing promoting any author must be accurate and reflect the product or service actually provided by the author.
  • The listing must make no claims that it is representative of Six33Four NG or is endorsed by Six33Four NG.

Prohibited Content:

The following content is prohibited from any listings created by sellers:

  1. False, misleading, inaccurate, or unsubstantiated claims or content.
  2. Fictional third-party reviews, endorsements, or comments.
  3. Content that contains, promotes, or endorses:
    • Defamation, harassment, hate speech, racism, gender inequality, derogatory or distasteful, or misrepresentation against others.
    • Spyware, spam, Trojan horses, or viruses.
    • Illegal or unlawful activities.
    • Black Hat methods.
    • Method’s that may violate a third party network’s terms of service.
    • Methods that violate the Six33Four NG terms of service.

Six33Four NG reserves the right to delete, alter, edit, reject or remove any Listings that do not comply with these Guidelines or meet Six33Four NG’ standards. Six33Four NG may remove any offending Listings solely based on its own reasonable judgment.
